Requirements of a Prenuptial Agreement in Thailand

It is important that before you get married and live in Thailand that you consider a prenuptial agreement. A prenuptial agreement will protect certain relationships where there is an imbalance of financial assets.

Many foreign nationals come to Thailand after working and accumulating assets overseas. They may meet and fall in love with a Thai national who do not have their own assets.

In the back of their mind, the foreign national fears that the Thai national is marrying them for other reasons than love.

A properly prepared and filed prenuptial agreement will clear away the fears and open up the door for marriage.

In this video, I will go through the requirements of a prenuptial agreement.

A prenuptial agreement is an agreement between you and your future spouse summarizing your personal assets and liabilities before marriage. In addition, the prenuptial agreement will aid in the fair allocation of property in the event of a divorce and reduce litigation cost. A prenuptial agreement will also ensure that your children from a previous marriage are protected in case of a divorce.

What are the requirements of a Prenuptial Agreement?

  1. The Prenuptial Agreement must be in writing.
  2. Each Party to the Agreement must understand the contents of the agreement. It is best if each party were represented a separate legal counsel to ensure understanding of the legal document.
  3. Two witnesses must be in presence at the signing of the agreement
  4. The agreement must be registered at the local district court prior to the registration of the marriage.
